What does guardianship mean?

Guardianship is not simply another word for custody. South African law treats care and contact on the one hand, and guardianship on the other, as distinct aspects of parental responsibilities and rights.

The Children’s Act permits an interested person to apply for an order granting guardianship, and requires the court to consider the child’s best interests and the relevant relationships. A translation follows the terminology of the order supplied.
