South African proceedings

Uniform Rule 60 provides that where a document in a language other than an official language of South Africa is produced in proceedings, it must generally be accompanied by a translation certified as correct by a sworn translator. A sworn translation is treated as prima facie correct and admissible.

The court keeps a limited discretion, for example where a sworn translator is not available or where requiring one would not serve the interests of justice, but the starting point in High Court matters is a sworn translation. South African immigration regulations specifically recognise court orders granting parental responsibilities and rights or legal guardianship in relevant child and immigration situations, and custody court orders feature in certain immigration applications. So a court order is not only a litigation document: it can form part of an immigration or administrative application, where a translation may be required by the authority receiving it.

A South African court order may be needed abroad for matters such as custody, guardianship, maintenance, family status, property, litigation, enforcement and immigration.

Translation and international authentication are separate issues. Department of Justice guidance on serving South African court documents abroad provides for documents to be translated into the foreign country’s official language where required, and describes the Registrar, Apostille and authentication procedures that apply.

Not every South African court order automatically needs an Apostille. The destination court or authority determines its own requirements, so confirm them before submitting anything.

DIRCO explains that High Courts issue Apostilles for relevant documents destined for Apostille Convention countries, while authentication routes apply in other situations. A receiving authority may require translation, authentication, both, or neither, so confirm its requirements before submission.

Family matters

Custody, guardianship and parental-rights court orders.

Family-related court orders can determine custody, guardianship, parental responsibilities and rights, permission concerning children, maintenance, and travel-related authority.

South African immigration rules expressly identify court orders granting full parental responsibilities and rights or legal guardianship in certain child-travel situations, which is why these orders are often translated for use with the Department of Home Affairs or a foreign authority.

Cross-border maintenance

Maintenance court order translation.

South Africa has arrangements for the reciprocal enforcement of certain maintenance orders internationally. Department of Justice guidance identifies certified copies of provisional court orders, affidavits, birth certificates, marriage certificates and related evidence among the documents involved in some international maintenance matters.

Where any of those documents are in another language, translation may be required. Send the full set together so the bundle can be quoted as one.

Do the annexures need translation too?

A court order may refer to settlement agreements, parenting plans, schedules, property descriptions, affidavits, exhibits and other attached orders.

If the receiving authority needs the complete record, those related documents may also need translation. Send the complete document bundle before requesting a quote, so nothing has to be added and re-quoted later.
