Power of attorney translation for use abroad.
DIRCO’s legalisation guidance includes powers of attorney among the private documents that may need to follow the Public Notary or Sworn Translator route, then verification by the Registrar of the High Court, then an Apostille or authentication, when they are required for use overseas.
The exact route depends on the destination country, whether the original document must be notarised, whether a translation is required, whether the destination is party to the Apostille Convention, and the instructions of the receiving authority. Not every power of attorney needs an Apostille, so confirm the requirements before starting.

Foreign power of attorney for use in South Africa.
A power of attorney issued abroad is often presented in South Africa for property transactions, litigation, banking, company matters, tax, estate administration, and government or administrative processes.
Where it is in another language, the South African attorney, institution, court or authority receiving it may require a translation. The legal validity of the underlying power of attorney is a separate question from the translation itself, and is determined by the person or body relying on it.
Property-related power of attorney translation.
Powers of attorney are frequently used where someone authorises another person to sign or act in relation to property while they are out of the country.
The translation stays focused on the document: the property description, deeds-office terminology, the transaction powers granted, the authority to sign, names and identity details, and any notarial wording. It is a translation of the authority document, not conveyancing advice, so confirm the property-law requirements with the conveyancer or attorney handling the transfer.
SARS and tax power of attorney translation.
SARS recognises special power-of-attorney forms that allow representatives and tax practitioners to act for taxpayers in specified circumstances.
If a foreign-language authority document is being presented in a tax matter, the translation requirements should be confirmed with SARS or with the professional handling the matter before it is submitted.
Power of attorney for document submission or collection.
DIRCO’s legalisation booking guidance notes that a non-family member submitting documents on behalf of another person may need a special power of attorney or a letter of authority, together with identity evidence.
Where that authority document is in another language, it may itself need translation. Send it together with the documents it relates to, and tell us which office will receive it.
Should the power of attorney be translated before or after signing?
There is no single rule. If the document has not yet been signed, tell us where it will be used and give us any instructions from the receiving attorney, notary, embassy or authority before it is finalised.
Some processes call for the original-language document, the translation, notarial execution or legalisation to be completed in a particular order. Confirming this first avoids completing the wrong formality and having to start again.
